The AP government on Tuesday requested the state high court to direct the Central government and the CBI to probe the alleged scams that had taken place during the previous TDP regime.
State advocate general Subrahmanyam Sriram made the request while arguing on behalf of the Jagan Mohan Reddy government during the hearing on a petition filed by the Telugu Desam Party leaders seeking to quash the investigation by the Special Investigation Team (SIT) of the police.
The AG told the court that the state government had already written to the Central government asking for a CBI inquiry in the scam committed by the previous government.
He requested the court to make the Central government, CBI and Enforcement directorate as parties in the present writ petition and direct them to implead in the case.
He argued that the elected government of the day has the power to review its administrative policies and there is no constitutional bar for that.
The government had constituted SIT in accordance with the provisions of CRPC and there is no violation of law, he said.
Asking the high court to dismiss the writ petition, the AG said the petitioners were the ‘proxies of the accused’ who are likely to be investigated by the SIT in the land scams.
“They have no locus standi in the case, as there is no violation of their fundamental rights or statutory rights,” he said.
He said the petitioners had failed to demonstrate how the state government’s orders in this regard will affect them personally.
Also, they could not demonstrate to the court any violation of constitutional provisions in this matter, he added.
The AG brought to the notice of the high court that the state government has written to it (high court) requesting for the allotment of a designated court for the functioning of the SIT and that it is still waiting for a response from the high court.
