2017 has been a rough year for H1B employees with the new administration policies. Indian Implementation partners are renegotiating their existing contracts with clients for higher billing rates or sending work offshore completely.
In the year 2016, only 3,930 green cards were issued to EB2 India compared to 23,527 in 2011 according to Department of State statistics. This is due to the fact that the rollover green card numbers from EB1 India to EB2 India have become negligible because EB1 multinational manager category is gobbling all EB1 green cards.
Before 2012, EB1 category was used only by extraordinary PhD candidates. Now most of the Indian EB1 category green cards are being issued to Indian Implementation Partners Project Managers and Tech Leads.
Singapore is rarely issuing work passes. Australia has abolished its 457-work permit visa. New Zealand has toughened its work permit by increasing work permit minimum salary requirement to 150% of the median income. Canada is making sure that a position is advertised for locals for 28 days before an overseas employee can be hired by the temporary foreign worker program.
However, people should understand that all this negativity is cyclic. The state of economy of a nation is not constant. They are always good time times and bad times for every nation.
In 2008, the prices of houses in USA went down by 50%. In most areas, the prices are back to pre-2008 times or more expensive now.
However, it is a bad situation for H1B employees when they are laid off from their job and must return to India. It would be very difficult for him to find a full-time employer who can sponsor them from India or a consulting firm or implementation partner who can put them in a client project and get a client letter to file a new H1B petition.
It is not easy for H1B employee to come back to USA on H1B visa again just because he or she is cap exempt. They should do their best to stay in United States by finding another employer. They should make use of the one-time 60-day grace period issued by the previous administration for employees in H1B status.
