The Congress party in Telangana which has been completely beleaguered due to defection of 11 of its 19 MLAs to the Telangana Rashtra Samithi, has failed to get much needed relief in the high court on Tuesday.
The Congress leaders led by PCC chief N Uttam Kumar Reddy and CLP leader Mallu Bhatti Vikramarka moved the high court challenging the plan of the defected Congress MLAs to merge the CLP with the TRS legislature party.
Bhatti and Uttam brought the merger of Legislature Council to the notice of High Court and claimed that it is against the Indian constitution.
They also mentioned in the petition that the speakers of assembly and council are not considering their complaints and so High Court should send directives to them to take a call on the MLAs who have defected from Congress to TRS.
A division bench of the high court comprising acting chief justice Raghavendra Singh Chouhan and justice A Rajasekhar Reddy, however, felt there was no necessity to hear the petition urgently and postponed the hearing to June 16.
However, the bench asserted that there would be legal action against the eleven MLAs who defected to TRS.
Though the Congress leaders may feel this is a relief, they cannot do anything if a couple of more MLAs defect to the TRS and call for a CLP meeting to resolve on the merger of the CLP with the TRSLP.
The high court also cannot interfere in the matter, as the powers of accepting the merger lies with the Speaker. Even if the high court says the merger is illegal, the Speaker has the power to decide on the disqualification of the defectors.
Since the next hearing takes place only on June 16, anything can happen during this period!
