Nimmagadda Episode Back To SC!

The legal battle between retired IAS officer Nimmagadda Ramesh Kumar and the YSR Congress party government in Andhra Pradesh over his reinstatement as the State Election Commissioner continues to shuttle between Amaravati and New Delhi.

On Monday, when Nimmagadda approached Governor Biswabhushan Harichandan at Raj Bhavan in Vijayawada, requesting that he be restored as the SEC as per the high court directions, the Jagan Mohan Reddy government moved a fresh petition in Supreme Court to stall any such move to reinstate the SEC.

Nimmagadda told the Governor that he had approached the latter as per the high court directions. He told the Governor that the high court, which had given its verdict on his contempt petition against the government, stated that its earlier judgement on his reinstatement as the SEC was valid as the Supreme Court had refused to grant the stay thrice.

However, the YSRC government moved the Supreme Court again seeking a stay on the high court taking up the contempt petition filed by Nimmagadda.

It argued that the high court cannot take up the contempt petition at a time when the matter was pending before the Supreme Court.

If the government follows the high court order, it would mean the special leave petition filed in the SC would become redundant.

So, the high court cannot take up any such petition when the issue was pending before the SC, the Jagan government argued.
