Urgency for OPT to find H-1B employers by Dec 31st

Recently USCIS published a proposed rule that would change the process for submitting H-1B cap petitions that opens April 1st. The change is also designed to boost the number of H-1B recipients with a Master’s degree or higher from US institutions by 16 percent.

However advance preparation is crucial to ensuring a complete H-1B petition is ready to file with USCIS on April 1st.

The proposed rule would require petitioners (employers) to electronically register with USCIS during a designated registration period – the designated registration period would be at least 14 calendar days long prior to April 1st. USCIS would give at least 30 days advance notice before the opening of the registration period.

On April 1, 2019, USCIS will begin accepting cap subject H-1B petitions for a start date of October 1, 2019 (FY2020).Due to the high demand for H-1B visas and newly proposed rulemaking for cap-subject petitions, employers should take time NOW to identify any employees who may require first-time H-1B sponsorship.
