A Texas daycare owner has come under scrutiny after a viral video showed him being confronted over allegations that his businesses sponsored dozens of foreign workers through the US H-1B visa programme—claims critics have dubbed a “pay-to-play” scheme.
The footage, shared by BlazeTV and commentator Sara Gonzales, captures her questioning the operator of Allen Infant Care Center, formerly known as Golden Acorn Academy, in North Texas.
Gonzales alleged that the daycare is linked to Golden Qi Holdings LLC and DFW ABA Center, an autism therapy provider.
According to her findings, the businesses have collectively filed more than 50 labour condition applications and sponsored at least 37 H-1B workers.
Some of the roles listed—such as market research analyst and supply chain analyst—appear unrelated to daycare or childcare services, raising further questions.
During the confrontation, the owner, identified as Yuan Yao, declined to answer most queries and repeatedly directed Gonzales to his lawyer.
“I only can tell you, everything is legal,” he said, refusing to provide documentation.
Gonzales also claimed that the required public access records—mandatory under H-1B regulations—were not produced during the exchange.
The video further includes allegations from a whistleblower said to be familiar with the operations.
The individual claimed visas were being sold, with foreign workers allegedly paying up to $20,000 for sponsorship. It was also alleged that some employees were underpaid after arriving in the US.
Questions have also been raised about whether the daycare facility is actively operating. Gonzales noted during her visit that the centre appeared closed and undergoing changes.
Additionally, the businesses are reported to have received over $100,000 in Paycheck Protection Program (PPP) loans, which were later forgiven.
The H-1B visa programme allows US employers to hire foreign professionals for specialised roles, but mandates genuine job requirements and adherence to prescribed wage standards.
Gonzales said she plans to submit her findings to federal authorities, questioning why an allegedly inactive daycare would continue filing H-1B petitions.
The controversy comes amid a broader probe led by Ken Paxton into suspected H-1B misuse in North Texas, where authorities have already issued civil demands to companies accused of running “ghost” operations while sponsoring foreign workers.
