YS Jagan Prolonged Detention - A Constitutional Violation

Request to oppose gross violation of human rights in India and utilization of government institutions for political vendetta, to settle political scores.

I submit the following very serious considerations to my esteemed fellow Indians, with great respect, in the belief that this will bring forth to your notice the evidences of gross misuse of the government’s power by the Congress(I) led UPA government of India. The current UPA government of India headed by Congress(I) party has been grossly misusing the power manifested in them and trampling on the constitutional rights of the citizens of India, especially those of political opponents while law and order, social rest and economy are deteriorating in the nation.

The atrocities of the present Congress(I) led UPA government against their political opponents is unprecedented in the Political & Legal history of the Country; it typically exemplifies as to how the Congress Party High Command has been using every institution in the Country to stifle political dissent. The Central Bureau of Investigation (CBI) has pressed charges against several political stalwarts of the country like Mr. Mulayam Singh Yadav, Ms. Mayavathi and most importantly, Mr. Y S Jaganmohan Reddy wishing to bring them to their knees. The curious case of Mr. Jaganmohan Reddy is unprecedented in the blatant display of misuse of government institutions like the CBI.

It is not just the CBI that is acting like a tool to the UPA to help in political witch hunting, but the judiciary and the justice department which are supposed to safeguard the constitution and the interests of the people were forced to become a helpless spectator.

In the case of Mr. Y S Jaganmohan Reddy who is also a Member of Parliament, won with highest majority, I would like to bring a few points to your notice.

Mr. Y S Jagan has been arrested and put behind bars for the past seven months, with no wrong doing established or proven. The way the cases were brought to the front and the way the CBI has been functioning from day one have shown nothing but humiliation of the justice system and mockery of democracy in the world’s largest democracy. It has political vendetta written all over it. Presently, it is widely believed in the political circles that ruling clan of Indian federal government is using investigative agencies as well as the legal establishment to their political advantage.

Perhaps, granting authorization to CBI to investigate the allegations on Mr. Y. S. Jagan, while blatant decline of the same to an ex-head of the state from an opponent party obviously shows the nexus of the ruling political leadership and purported independent constitutional bodies. It is to be noted here that CBI was ordered enquiry just basing on the PIL filed by the political opponents of Mr. Y. S. Jagan and his father late Dr. Y. S. Rajashekar Reddy, erstwhile chief minister of the state of Andhra Pradesh.

It should be clearly understood that main charges in the public interest litigation (PIL) filed by Dr. Shankar Rao of Congress(I) and Mr. Ashok Gajapati Raju & others belonging to another opponent political party against Mr. Y. S. Jagan claiming that the State Government issued 26 GOs during 2004-09, allegedly paving the way for loot of the public property and as quid pro quo whereof, the said beneficiaries of the alleged illegal GOs have invested in the share capital of the Companies with which Mr. Y S Jaganmohan Reddy son of the then Chief Minister Dr Y S Rajasekhara Reddy is connected. All this started after Dr. Y S Rajashekar Reddy then CM had tragic death in a plane crash and subsequently Mr. Y S Jagan differed with Congress (I) due to their dictatorial attitude. The cabinet ministers authorized to issue the GO’s have informed the Supreme Court that all the GO’s that were issued were according to the business rules under the law and they all stand by them unequivocally. Mr. Y S Jaganmohan Reddy is still languishing in jail without being successful to secure a bail, due to CBI ignorance in upholding fundamental rights of a citizen given by Indian Constitution and because of CBI’s selective use of legal guidelines, while other politicians who are in good books with the government are leading lives happily with their respective families.

More than 2000 phones are under surveillance of CBI. By threatening some of the vulnerable persons such as peons and clerks, the CBI is forcibly trying to collect confessions under Section 164 Cr PC, apparently to terrorize all those who are close to Mr. Y S Jaganmohan Reddy’s family. For the first time in legal history, summons are being issued for securing testimony under Section 164 Cr PC although the law is clear that testimony under that section should be voluntary.

All these blatant irregularities by the Congress (I) led UPA government of India using CBI to harass their political opponents are only reminiscent of the atrocities committed against the likes of Ms. Ang Saan Syu Ki, Mr. Nelson Mandela and few other world leaders who suffered in jails as victims of political vendetta for standing up to the autocratic totalitarian attitude of the respective governments and police states.

I humbly urge you to register your protest to the President of India by signing the petition through below links to address these gross violations of the constitutional rights of an elected representative who has people’s mandate and question the actions of the government, so as to force the government to uphold the constitutional rights of all Indian citizens equally.
