Risk of H1-B Layoff

Information Technology jobs market has become very dynamic these days. Many remember the days of 1990 to 2010 when IT jobs were highly paid, less stressful and had a proper work life balance.

The Indian Implementation Partners have changed the rules of the game. A project which would normally take 2 years to complete is being bid as a 6 Months project to clients.

Aggressive deadlines and deliverables are the order of the day. Proof of concepts are also becoming popular with Indian Implementation Partners.

Failure of projects is becoming common due to these strategies. Many full time employees working for end clients or implementation partners are being subject to the risk of layoff in the last quarter of 2016.

Many Indian Implementation Partners are planning to send their H1-B visa employees to India for 6 months to 1 year and bring them back when the US Presidential elections are over and economy has improved.

Contrary to the popular belief there is no grace period of 10 days in the event of layoff for a H1-B visa employee. It is wise for the H1-B visa employee to proactively search for a new employer and file for a H1-B visa and keep the H1-B transfer receipt handy.

If your think that you may be subject to an imminent layoff or your employer is not filing your green card or need to upgrade from EB3 to EB2 category this is the right time to find a new employer, do H1-B transfer and start the green card process.
