Editorial: Drinking And Then Raping Is Legal?

The issue that is burning the entire nation and putting every civilized citizen to shame is the gang rape incident which took place in Delhi. While the victim is battling for her life, a massive movement is going on protesting the failure of the system and demanding death penalty to the rapists. Their anguish is justified and the criticism is also fair but here are few facts. We live in a democracy which is governed by a judiciary with a set of laws.
 
According to a source, it is heard that recently the Supreme Court commuted a death sentence of a rapist to life imprisonment. According to the judge, the heinous act of rape he committed was under the influence of alcohol so technically he didn’t have the realization of what he was doing at that point of time. So, this means that a drunkard has a legal right to do any act of crime and get away with it.
 
As a society and legal system, it is the law which is promoting and encouraging drunkards to do as per their whims and fancies but blame their mental condition at that point of time if something goes wrong. Is it fair? Is that how the law is supposed to work? The gangrape incident which took place at Delhi also had the rapists in a drunken state.
 
Does that mean they would be having a punishment giving them credit for their mental state? And what good is it if the rapists are given life imprisonment? How does that help anyone? Will it be a worthy payback to the victim who underwent that torture? There are many such beasts who are currently in the jail getting fed on public money. Where is the common sense fundamental in this legality? It is a shame if the government cannot make this law severe and it is definitely not the democracy that a common man is looking for.
