Court says no to narco test on Jagan

In a big relief to YSR Congress party president Y S Jaganmohan Reddy, the CBI special court on Monday dismissed the petition of the CBI requesting permission to conduct narco-analysis and other scientific tests on him and his close aide V Vijay Sai Reddy in connection with his alleged disproportionate assets case.

CBI court principal judge U Durgaprasada Rao delivered the judgement on Monday after completing the prolonged hearings of both the sides on July 4.

The judge agreed with the argument of Jagan’s lawyers that the narco-analysis test could not be conducted on an accused without his consent, as per the guidelines laid down by the Supreme Court.

The lawyers strongly argued hat Jagan and Sai Reddy were not willing to undergo the tests as they could not be forcibly made witnesses against themselves. They also opposed the CBI petition on the ground that the tests could lead to health complications and endanger their lives.

The CBI authorities, in their petition, sought permission from the court to conduct scientific tests such as narco-analysis, polygraph and brain mapping tests on Jagan and Sai Reddy, as they were hiding vital information pertaining to the illegal assets case.

“Jagan had not divulged any information during the interrogation when he was in our custody for seven days in two spells. We have several leads in the case and when we questioned him, he could not give satisfactory replies. Jagan has the knowledge of all the details of the alleged hawala transactions but is not disclosing the same. In order to help and aid proper, just fair and fearless investigation into the matter, the CBI seeks the court permission for using scientific ways for deriving information from Jagan and Sai Reddy,” the CBI officials said.

The court, however, rejected the CBI argument and dismissed its petition.
