Cash-For-Vote: Naidu To Escape On Technical Grounds?

It is a known fact that Telugu Desam Party president and Andhra Pradesh chief minister N Chandrababu Naidu is an expert in escaping investigations in various scams on technical grounds.

He can manage from top to bottom to wriggle out of any case against him taking advantage of small technical hitches.

Following the ACB court’s order asking the ACB to re-investigate the cash-for-vote scam involving the Telugu Desam Party leaders who sought to bribe a nominated MLA to vote in favour of the party nominee in the MLC elections last year, the YSR Congress party leaders confident that Naidu would not be able to escape from prosecution this time since it has been confirmed that the voice sample in the leaked audio-tape was indeed that of Naidu.

Sources, however, say Naidu has every possibility of escaping from the case. For, the audio tape was analysed by a private forensic laboratory – Helik Advisory Ltd of Mumbai, at the instance of YSR Congress party MLA A Ramakrishna Reddy, who was the petitioner in the case.

According to sources, courts normally do not consider reports of a private agency. At the most, the private laboratory’s report can be used as an investigating tool but not as evidence.

As per the rules, the investigating agency can rely officially on the forensic test results given by the Central Forensic Sciences Laboratory at Hyderabad, Kolkata, Chandigarh, Guwahati, Bhopal and Pune. Otherwise, the state forensic laboratory is also authorised to conduct the forensic test.

This will come to the rescue of Naidu, who can easily manipulate the reports at the Central and state forensic laboratories and get the report in his favour. The Telangana government in Hyderabad and the NDA government at the Centre can bail Naidu out. So, there is every possibility that Naidu can wriggle out of the case!
